An elementary school teacher has sued a student who ran into her in a school hallway.

In the suit filed in February in Superior Court in Camden, Eileen Blau says the injuries cost her money for medical care and curtailed normal activities.

The lawsuit claims Daniel Allen, who was then 11 and weighed about 90 pounds, "negligently and carelessly" collided with her at an "excessive rate of speed."

The second-grade teacher at E.T. Hamilton School said she suffered "severe and multiple injuries, some of which are permanent in nature."

A Camden County Sheriff's deputy served the summons to the Allens at 7:30 a.m. Wednesday. Stacy Allen, Daniel's mom, said the deputy apologized, with a chagrined look, when told the summons was being delivered to a 13-year-old.

Stacy Allen said she was a lot more than chagrined.

"I think it's terrible that a teacher can sue a student," Allen said. "Maybe he should not have been running in the hall, but I think it was an accident. When you send a kid off to school, you expect him to be supervised and taken care of. You never expect a teacher to sue a child for running into her."

Calls for comment Friday to Blau, her attorney Craig R. Fishman and school Superintendent Raymond J. Brosel Jr. were not returned.

Steven Baker, a spokesman for the New Jersey Education Association, an advocacy and labor bargaining unit for 162,044 educators statewide, said a case like this is a first.

"I've never heard of a situation like this before," Baker said. "I assume it is quite uncommon."

Stacy Allen said the school principal, Kristine diCoio, told her the incident, which happened on April 11, 2001, was an accident. Allen said Blau filed a claim with the family's homeowners insurance for her injuries in the fall of 2001. She said her insurance company said the claim was not settled.

Allen said she never told her son about the teacher's actions because she didn't want to upset him. When a sheriff's deputy showed up Wednesday, the secret was out.

"He didn't understand why someone would want to do this to him," she said. "He said `Why does she hate me? Why is she doing this. I said I was sorry.' "

Daniel said he was running to catch a bus home when he ran into Blau. He said he cried in the principal's office the next day when he found out Blau was hurt.

"I'm sorry I ran into her," Daniel said. "I don't think she should be suing me. I didn't want to hurt anybody. It was an accident."

A trial date has not yet been set. Stacy Allen said the family is still deciding on whether to get a lawyer.

It doesn't say anything about the nature of her injuries. I don't think someone would sue over a few bumps and bruises from someone running into them. Maybe she got really hurt. If that was the case, and she hadn't resolved it with an insurance company, then the teacher may have felt that her only remaining avenue to recover some medical costs would have been to sue. Unfortunately the article only portrays one side of the story really.

How could a little 90 pound kid cause serious injuries to a lady unless he knocked her down a flight of stairs or something.

are you guys kidding? You honestly telling me you've never known any petite women that weigh all of 104pounds?Are all the women you know Big Fat Bitchs?

I'll bet you that her insurace won't cover her bills to the point where its been advised the only way she can not be screwed is to go after the family.
I would be nice if she would just swallow a 60,000 dollar bill on her own ..i mean you all would if the tables were turned... totaly one sided story here.

or she didnt have insurance that was worth a shit. i really doubt she got hurt that bad. ive fallen down stairs drunk and come out with just a couple bruises. i still dont think she should sue him. its the schools fault he was running. his teachers couldnt control him. if anything she should sue his teacher or the school.

A im 110 lbs 5'7" and well ... fragile Shocked my 8 year old can pick me up off my feet and hes not a *big* boy. dont under estimate the strength of those little buggers!

B wasnt she one of his teaches that should have been 'controlling' him? she should sue herself for not doing a sufficient job! Razz

Guess my old elementary school got lucky when he smashed our librarians face in by running into a push open door ^^;

As far as I know the guyhad to have several surgeries to fix up his nose.

it's not the school's fault. i'm sure one of the school rules are 'no running' and the kid wasen't following the rules. the rules are there for the safety of the students and staff and this just goes to show why rules are so important and need to be followed.

yes i agree but they imo, are at fault for not enforceing the rules. he is just a kid and no matter how well behaved at home, no matter how well he is brought up. he is still just a kid. you have to keep an eye on them. also kids running generlly make alot of noise with their feet. she should have heard that or at least been aware of her surroundings.

no matter how you justify it. it was an accident. sueing a child is wrong.
i think if her insurance wont pay for it she should also try sueing them first. if its not covered in her plan because she elected a cheaper one. then she is sol. i dont know if thats the case but if i were on that jury or if i were the judge i would throw her out.

nobody ever deserves money for suffering imo

Of course the woman has the right to sue. Whether it will be held up in court is entirely different. This is one way of setting one hell of a precedent in that school though. I've been hit by a car, fallen down stairs, hell I even took a charge from Danny Fortson on pavement and have shaken it off. Once I slipped on ice and shattered my elbow. It's not how the incident occurs, it's about the injuries that happen from the incident.
