I think the laws for how they are punished should be scaled end of story. If the porn involves 17 year old then they get X amount of years. But if it involves 7 year old then they get X+200 years. You catching my drift? If child pornography is illegal becuase of moral reasons ( I'm not sure the exact reasons it's specific as illegal, i mean it's fairly obvious, but I mean from a legal standpoint ) then a lot of other porn should be illegal as well plain and simgple. If they do not then the law is stupid and unjust and just makes the entire issue deteriorate into chaos when things like what Themy posted happened. The laws need to be more exact and cover more issues, period. They are a joke in current form.

A teen age couple were engaging in **** from ages 15+, The boyfriend happened to film himself having **** with his girlfriend at some point in time when they were 16. His mother was cleaning his room and found the video and called her parents. They became furious and eventually for some reason the police caught wind of the situation. The boyfriend was charged with possession of child pornography. HOW f*****g STUPID IS THAT? There are more examples I can find, but it should be obvious to most already that the law is a joke, and to those whom it isn't I'm not going to bother with. |

The government knows that young people around/younger than the age of 18 are easily manipulated into these types of situations. People are manipulated into joining gangs for safety in urban areas, rather than staying out of trouble and avoiding the situation completely. It's all a matter of perception, and someone has to set down a law or boundry to help people discern right from wrong.
When an individual reaches the age of 18, it has been widely agreed upon that that individual has earned his/her right to involve themselves with these types of acts. Individuals in america become independant at the age of 18, with a free reign of American liberties. One that includes involvement in pornography. Anything under this age is considered "Child pornography" which has been deemed illegal. It doesn't matter whether she consented or not, it wouldn't specifically state that in the video, and so it is left up to the unfortunate viewer of said pornagraphy to decide, "is this right?"
The law says no, it isn't right and it is against the law, no matter how severe of an infraction of the law it is.
Your friend got busted with one of these videos, so they arrested him and gave him the proper punishment.

People having **** at age 16 isnt illegal in most states, and 2 states have the age set to 14 or above. In what states is it legal to have **** with a 14 year old. What are the details in this law concerning have this ****. meaning, do you have to be married to have the ****, does it require parental consent?
Do you have this information?

Hawaii is one, I believe Pennsylvania is the other. Check google if I'm wrong. Quite a few states are 16 as well. And there are a few odd ones with 15/17 though not many.
As far as I know that is the age someone can consent to have ****. I believe some of them have other laws such as they can consent but the other person has to be within 6 year or something.. but that is a vague recollection and may be incorrect.
On a final note. Does it really matter what age it is if it's under 18? If the age of consent is lower then the whole thing is a joke.

You make it sound like a 14 year old in some states, can just walk out the front door and f**k anyone, of any age, if they want.
That is not the case.
In most if not all states they have a legal age of consent that requires no parental consent. Then the have lower ages that require parental consent, a judges consent, sometimes both.
Here is an example from New Mexico.

My point is that the laws regarding child pornography are comedic since a 16 year old is considered the same as a 6 year old. I don't know what the exact punishments are. I just know that a 6 year old is 10 if not a 100 times worse then a 16 year old. The law should address that and punish people to the extent of their crime.
For example. A 17 should be the same thing as a DUI. Where a 7 year old should be the chair without them wetting the sponge.
Also I believe it should address things such as **** torture on film, scat/urine porn, films of rape, snuff porn, beastiality, etc. I believe if you are going to punish one you should punish all of them otherwise it looks ridicilous, don't you think so?

I think you are to broad in your statements. I'm not up on the exacts of the child porn laws. Are you? And I mean all the little details. You say a 6 year old is looked at exactly as a 16 year old is. I'm not sure thats 100% true, just because you claim it is. You also mix that issue in with 10 others, you cloud your argument making it weak. Its kind of hard to see your exact point. And once the point is identified are you basing your argument on true knowledge of the law or just guessing?

I know for certain that the punishment for anything deemed child pornography is horrendous, and that some of this child porn is 1% away from being adult porn.
My overall point?

technically yes but unless you made it known to people that you had it or showed it to people they cant do anything, privacy laws prevent them for really going deeply into what you do in your own house without real proof. So unless you flaunted that you had it they cant do anything. its kinda a grey area of the law.

I understand Mugaaz's point here, finding girls at the age of 17 to be attractive while being 20 yourself is not a horrendous offense. They are underage, yes, according to America's social structure at this point, but that does not mean men will stop finding girls under this age attractive.
It means they have to be responsible enough to make these decisions, and have the proper motivation and permission to be having ****. If these children are having **** without parental or judicial permission, they are doing something wrong, and it's left up to the parents of either party to employ proper punishment. Whether or not they leave it up to the government to punish the kid(s) is up to the parent(s).
Any girl under the age of 18, according to California's standards, is not yet old enough to participate in **** acts in front of a camera for the purpose of distribution. You need parental permission or judicial permission just to have **** in the first place. Obviously, the people in the videos your friend was watching did not have any type of permission to be having **** and are recording/distributing it, which is a double offense. It doesn't matter if the girl in the video is a total s**t and consented, she can't consent herself, she needs parental or judicial permission. She is getting taken advantage of, she is a minor.
It is illegal for your friend to view said material. He had this stuff, he was punished. That is it. It doesn't matter how far down into his psyche you delve, he was in the wrong and he was punished. Tough shit man, you live and you learn.

Actually, this is exactly the reason why there are laws in place. Please note the 'if it wasn't illegal' part. He can control himself *because* it is illegal.
While I would agree that there are young people that are capable of consent before they reach legal age, the legal system has to set an age at which it is determined that a large majority can consent. These laws don't just protect against forcible rape, but also mental/emotional coercion, and just plain bad judgment. From a psychological point of view, young people are experiencing overwhelming **** responses and are learning how to deal with them. Since we do not live in a perfect world in which responsible adults realize this and react accordingly, laws are required that protect the young not just from predators, but from themselves.
Given the difficulty of proving rape in our legal system, having these laws in place is necessary. If our system required that a young woman (or man) had to go through what adult victims are put through, there would be almost no protection under law except in the most extreme and/or easily tried cases.

No that just means he wouldn't do it because he is scared of going to jail .
