I'm sure everybody has seen this story by now. It's kind of an intriguing question though. Who do you think is right? In one sense, rules and privacy should be inviolable. What if there were things in his email he didn't want his parents to see, even on death? On the other hand, if they inherit his effects, you could say that the email is simply another of his effects that pass to them.
I'm pretty sure if they knew he had a swiss bank account, but didn't know the number, they wouldn't be able to get the money. On the other hand, they'd probably be allowed to go into his apartment.

The policy of Yahoo! is to erase the entire account after it has been idle for 90 days. It's not known when Ellsworth last used the account. He died Nov. 3, meaning the account would be erased by Feb. 1. |

If the emails were not intended to be sent to the family, then they have no right to see it. If he wanted to send a letter to his family upon his death he should have hand written it or told a friend it is stored on his email account or whatever.

That's not true... if he had any secured assets like a safe deposit box, no one can get to it. If he wanted them to have access to his email he would have written it somewhere or told someone about it.
Why does the father want to see his email, anyways? What's he looking for?
Your analogy about the Swiss bank is correct, they don't have the key to the account (the password) in other words, they don't belong in there. Yahoo accounts aren't terribly hard to break into anyways, if it was a legit email address, the birthday and secret question info would have been more or less predictable or guessable with his whole family present.
