thwy wouldn't be able to put "ads in the sky" for one simple fact. the sky is not one sole person's. For the same reason that one cannot put signs up on public propperty one cannot write something in the sky. Now seeing as how the "air space" above a country is that country's airspace it would be cool to see if private people could justify owning anything, but i doubt it will come to that. But as of now the only way to use the air to advertise would be on a private entity (such as blimp or plane). Same thing goes for people standing at intersections with signs for companies.

hrmmm. you got me thinking. what about those searchlights stores and bars use to shine up on the clouds. I don't think in the U.S. we have any laws against shining lights, or emitting radio waves in the sky. I could be wrong though

right, but that's not a specific ad space. if these lights are moving maybe it could be possible, but not if they have to sit in the same spot forever.

3 combinations to think about which make ads in the sky legal:
Compare to mineral rights
Compare to the analogy of water from a fountain. You still own water pumped from a source below you, into a fountain, and sprayed into the air, don't you? Sure do!
A fountain is just water ejected from a pump you own.
I'm sure some scumbag will be able to prove to the courts that any energy emitted from ground-based devices is still their property, no matter where it lands.
