K, just curious about some legal stuff.

Hypothetically, if you were getting divorced, and your soon to be ex spouse demanded a trial to settle temporary custody, and you ended up paying your very expensive lawyer for the prep work for the trial, then your soon to be ex spouse never showed up for the trial, would you be able to stick her with the fee's you had to pay your lawyer for the prep work?

Also, if your soon to be ex spouse got a new lawyer, and started feeding her a bunch of misinformation, which caused your lawyer to have to respond to her lawyer in a series of letters, which caused you to pay for his time once again, could you stick her with the bill for that also?

Civil courts would say that the husband is entitled to some restitution for extended legal fees.

I am the product of a divorce!

I was 9 years old when my parents started fighting for custody.

My parents were busy trying to figure out ways to f**k over each other.

My mother won just about every court trail they had.



It was prolly one of the worst times I have ever had to deal with in my life.

My parents divorce and custody battle took like 3 years.

Which later on began an even worse child support battle.






I'd say my life was f****d up for a good 5 years because of all that shit.

So Khrath make sure your son stays a happy little boy!!!

Khrath,

I'm about to begin custody with my X. My feelings are along the same lines as Asassin's comment, but stronger. There is no amount of money that is too great if I ended up with custody of my son.

What your X tells her lawyer doesn't mean a lick of shit. It's what the judge perceives as the best interest for the child which in the end (assume you both aren't crack dealers or murderers) amounts to who is the primary care giver. Basically the court will look to maintain status quo with the child. Most times that means stay with the mother, but for the fathers out there who are heavily involved you stand a chance.

Just document every god damn thing. EVERY single thing. Any threat she makes etc etc. Down to how much time you spend with your child every day and how much time she spends (also document activities). Avoid at all costs confrentation. Complete a parenting class that is recognized in the courts of your state (get a certificate) and also complete a Adult, Child & Infant CPR and First Aid class.

There is a lot more you can do to bolster your position but those are the basics.

Bottom line I feel for you and wish you well.

oh im getting custody, i have no doubt in my mind, im just p****d as hell about paying my lawyer all this extra money =p

The mother f****r costs me $200 an hour, it gets expensive =p

You are gonna have to pay. Only in extreme cases will the judge award legal fees in that type of situation.
