The posts that were lost:

1) there is a cybercrimes division of the US government

https://complaint.ic3.gov/Default.aspx

2) contacted paypal, said there wasn't anything that could be done with virtual items.

3) contacted credit card company for charge dispute, told them if they don't rectify it, would loose my business.

4) contacted lawyer( 2 in the family/free service).

So far its been a couple weeks or more and no delivery yet, they gave me some BS excuse that they were having email problems.

The dollar amount was 385 dollars. A significant amount for a young person not as fortunate. I would hate to have this happen to someone else.

heres an update on the situation, finally had a response after notifying them I was pursuing legal action.

"Please do not reply to this email"

Hello,

On April 10th of this year, our company and its affiliates split apart. As a result, your account information is with Gamepal/Gamewar, no longer with us. Please forward your concerns and questions to Gamewar and Gamepal.com now. They have your orders, your payments, etc and can further assist you. We no longer have access to that information. You are welcome to reverse your payments if they do not seem to want to help you. We have no control over the payment situations. We apologize for this inconvenience and hope that they further assist you with your problems. Again, this only affects those that have done any business with Gamewar and Gamepal.com up until April 10, 2008.

Thanks,

Accounts Manager

Hello,

On April 9th of this year, our company made some changes to our affiliate websites. Unfortunately, this caused some orders to have errors and they need to be reordered. For orders please simply reverse any paypal payments you may have sent us on or before April 9th. You will not be sought after for payment on these orders. Feel free to keep this email for your records in regard to that payment. Fortunately, the problems are fixed now and we gladly await your new orders. Please note that Gamewar.com and Gamepal.com are no longer working websites. This was part of the cause of the errors and the orders being lost. This is why we can not look this information up because we no longer have access to that information. You are welcome to reverse your payments if they do not seem to want to help you. We have no control over the payment situations. We apologize for this inconvenience. Again, this only affects those that have done any business with Gamewar and Gamepal.com and its affiliates up until April 10, 2008.

Thanks,

Accounts Manager

I understand when starting a new business there are growing pains, but 'word of mouth' advertising is the best form of advertising to grow your business. The money to me actually doesn't matter, its the whole process of not knowing and being kept in the dark after seeing all the performance guarantees posted at the site.

I've also talked to gamepal and state they can not do anything about it. Since gamepal is a US based company, I will also pursue action with them. Its hard when both companies are pointing the finger at each other and being caught in the middle. Someone pocketed the money.

But atleast I am thankful for the response from them.

Sounds like they are trying to pass the buck to avoid any bad rep. As for legal action, im pretty sure when engaging in business with them they made you agree to a contract that gives them zero liability damages, so not much you can do except report them for fraud to the IC3. It's less likely, but this could be a phishing site made by a pro scammer. I'll see what i can find out about this over the next few days.
