Well I know the MPAA(I think that's the correct acronym) started bringing up lawsuits like the RIAA did... so that might have something to do with it... I dunno tho.

tvtorrents.net is down as well.
www.elitetorrents.org is still up - one of the last remaining big hubs.
I do have to wonder why none of these P2P cases ever got in front of a court though - I understand why torrent pages shut down rather than risk a lawsuit, but it's quite frightening what you can achieve by bullying others, even if the law isn't on your side.
Imagine they could prove the MPAA was the one behind the recent DOS attacks on torrent pages - that along with some invasion of privacy charges could cause quite some trouble. After all evidence can only be admitted to court if it's been gathered legally, and in the case of the MPAA I do have my doubts...

Nope it's still up - just slow as hell and might take some tries to connect. They're probably getting swamped with the people from the other torrent sites.
On their front page they state:
| Quote: | 2004-12-17 - I know.. I know... we're evil! You can rest assured that ET is not gonna run and hide with it's tail between it's legs cough.... We're not breaking any laws according to the 9th circuit ruling and according to eff.org.. |
If it takes a court order to shut them down you can count on the page being up for a while - those things usually take time.

Not all of those pages have pirated software, movies or games.
Tvtorrents, for example, only had tvshows - which is imo a much smaller deal than the other subjects.
Games and Software translate to real loss to the publishers - definatly should be bought.
Movies - undecided here. Watching a movie on your pc monitor is nothing like watching it in a theater, so I'm not sure if it has a big effect. DVDs are another deal tho - definatly understand not allowing that
Tv Shows - again really different. Most of the money comes from advertisements, not subscriptions. Also most people who download the shows do so, because they don't even have access to the TV Channel (ie other country) - much less trouble to buy a cable subscription and record it with TiVo.
Buying DVDs years after the season aired just isn't a real option, especially if you haven't seen the show at all. If they'd sell some streamed TV channel I'd be all over it - but they dont. It's either bittorrent, or not watching it at all. And that translates to loss only for the company. I wouldn't have bought DVDs of "24" or "the west wing" if I couldn't have watched them online.

Copyright and Trademark law applies to all countries that signed the Bern Convention for the Protection of Literary and Artistic Works (ninja edit :p) - I'd be very surprised if Sweden didn't sign that, but I don't know for sure.

There is no such thing as an "International copyright" that will automatically protect an author's writings throughout the world. (Library of Congress)

that's right - not throughout the world. However it does apply in the US and at least every EU country.
| Quote: |
As members of the Berne Convention, the United States and all EU countries are required to provide a minimum term of copyright protection equal to the life of the author plus 50 years. Any country, however, may elect to provide a longer term of protection, as Belgium, Denmark, Finland, Germany, Greece, Ireland, Italy, Spain, Sweden, the United Kingdom, and others have already done, and as all other EU member countries are required to do under the EU Directive.

heh, should be interesting to see how the story plays out then.
Is p2p basicly as unkillable as the internet at this point?

from this reply
| Quote: | This raises the question of the reach of Swedish and European copyright
law. It is the opinion of us, and the Swedish Supreme Court, that
information about WHERE to obtain copyrighted material, which is the
case with Bit Torrent, is not illegal. The '.torrent' files that are
offered for download at the site in question contain nothing more than
hash and checksum information. How this information could, in itself,
possibly be an infrigement of your copyright is beyond us and apparently
the Swedish legal system agrees. |
so i guess the mpaa will have to prove that a torrent file is breaking
copyrights

I'm not even sure if the .torrent file is considered a copyright infrigment in the US - I don't think any cases like this ever went to a court.
For the torrent itself, think of it this way: You pay a drugdealer and he tells you where the drugs are hidden - can the dealer still be charged with anything? After all, how could he be charged with possession (+ intend to distribute) if he never had the drugs on him?
At this point it seems to be a shock and awe campaign trieing to get as many sites to shut down on their own. It's easy to predict that this would work for a short time, but sites will be back. If not those, then others to replace them.
Kind of like mp3 downloading went down A LOT when they sued the first couple downloaders - now it's back up to where it was before. Even if they sue more, it won't have the same effect anymore.

Yeah, it's been for a while now.
First people used newsgroups and IRC, then programs like kazaa made it available to the masses. Now it has more attention than it'd like, but you just can't stop it.
I read a statistic a few months ago that about 80m people in the US alone download from P2P networks - that's one out of 5. Chances of stopping it are about as good as making alcohol illegal - not going to happen.

I'm gonna say yes.
It's amazing how hard they're willing to try though.

people are just going to go back to using IRC and newsgroups to get links.
stopping 1 website where millions go is easy.
Stopping millions of individuals on millions of channels = impossible.

Apparently they were just changing domains, which is great news. I'd have missed tvtorrents a lot more than any of the others that went down.

This is great!
It is fun to see people who are breaking the law try to rationalize it. What is even better is that p2p networks arn't even "good" at pirating stuff. All the topsites and 0hour ftps is where the real stuff comes from.
If you happen to subscribe to WIRED go read the Jan05 issue. If you don't subscribe go read it at your favorite news stand.
I'm also sure there are a couple people on this board that still have contacts with 0hour stuff; you could talk to them.

Yup, I am cheap and dont' feel like spending an arm and a leg to see a movie. Honestly if movies were not as expensive as they are now, I would go to the movies to watch them.
Have been so busy the past few weeks that I didn't even know Suprnova and other torrent sites are down. Busy with work, finding a new pad, then getting furnature and the whole moving thing.
Well if someone wants to PM me some info that would be great and thanks guys! r00tus get your ftp site back up!!
