ever been asked questions by a police officer? Ever wonder what you should do or say if a officer starts pressing you for information? Asks to search your vehicle or look around your house (or even enter?) I have never been arrested or questioned but I always thought, what are my rights, what should I do?

http://portland.indymedia.org/en/2003/11/275261.shtml

This is soem good information, did you know a police officer can continue to question you until you invoke your miranda rights by saying "I invoke my miranda rights" or "I would liek to speak to a lawyer" and all the information he has gathered from you is admissable as evidence against you whether he has named you a suspect or not.

Be aware of your rights in these days because sure as shit they are being bent as much as possible in the name of "Protecting the public".

Anyone have information on searches for Vehicles? Kbarr? Lets say I was cruising down the road and I look like a hippy, I get pulled over what are my rights as far as refusing a search of my vehicle? I see police routinely go through peoples cars on Cops, is it legal? is there a way to deny them that ability?

What a rotten article.

Not only does it seem severely biased against cops - calling them pigs, and calling questioning 'piggy games' - but it also only has ONE point, which it repeats in every poorly written paragraph.

I'm all for knowing your rights. But if you're really interested in what your rights are I'm sure there are sites out there with more objective advice, written by someone who does not sound like he or she is a complete and utter tard.

Also: you have nothing to worry about if you're not doing anything wrong.

That's what I was thinking. The only time I would want to invoke my Miranda Rights would be if I knew I was guilty of some crime. In my experience, cops are usually on your side until you break the law.

As long as you're white, middle or upper class, not openly espousing any anti-establishment political views, and the cop's not having a bad day.

The vast majority are.. I have no problems with police officers, I trust them pretty inherently. But all cops are people, and some people are bad.

You guys are so innocent its almost Cute.

you know Cel there was a guy in belgium(think it was belgium, im sure you are familiar with the case) held for 7 years wthout a trial just recently, think he was a child molester, at any rate 7 years...... without a trial. I dont care what youve done you deserve to be charged and have a trial in a speedy fashion.

But really I can understand Celestra not identifying this, they have no miranda rights or protection from unlawful search and siezure in your country(correct me if im wrong).

You might think you have nothing to hide, but then again you dont know why the officer is gathering information on you, it might be something you are totally innocent of but are implicating yourself despite your innocence.

This is about rights, not whether you are guilty or innocent, you can say im innocent ive done nothing wrong (im sure there are many people in jail who are innocent, truly.

Do you know your rights?

The guy in the post sounds like a crazy anarchist etc etc.. There are gems of knowledge there to study. Remember the saying" just cause your paranoid doesnt mean that someone isnt out to get you". Protecting yourself and your rights can only be a good thing, who cares if it makes you look guilty at least you arent implicating yourself in some abstract way.

For instance, a cop pulls you over and asks you "do you know how fast you were going?" "umm yeah.. (you want to appear honest) 67 officer(ok he didnt have proof you were speeding, now he does "im gonna write you a ticket, you mind stepping out of your car?"
"Im going to search your car is that ok?"
"umm yeah sure" (ive got nothing to hide)
cop comes out with a bag of pot or coke "Is this yours?" (duh dan left his stash in my car)

Now you are f****d.

1. I live in America, so I'm not worried about being held for 7 years.
2. I don't have any friends that keep stashes of cocaine, let alone in my car.
3. If you tell a cop you were speeding, you are an idiot and deserve a ticket.

Saying that is against everything our country stand for. (I know your not american but I'm just speaking my opinion.) Here in America it should be that you should never be searched unless you are suspected of something. Not just for the hell of it. Having a cop randomly search your car is just not right. It's not freedom.

Now if there is a reasonable suspicion that is another story. Like searching a car at 3 am for alcohol might make sense.

I just don't agree with random searching.

Asking for a lawyer when you were speeding is probably not the best way to get out of it.

Chances are you were pulled over you are getting a ticket, why answer any questions, maybe he was looking for a car like yours as a suspect in some other deed. Again let me reiterate a policeofficer isnt going to say we suspect you are a drug dealer or a rapist, mind if I ask you some questions and search your vehicle?

why are your rights so easily relinquished? You think cause you are white you have immunity?

As for you taking my examples literally confused, it just shows how much of a idiot you are.

Bait,

Dude...

First of all I don't live in Belgium. Whatever f****d up things they do is pretty much their business.

Second of all... where do you get this insanity???

Let me put it this way: you're wrong.
Of course we are protected from people coming into your house at random and searching your stuff. Please get out of your country more.

Third: have you read my post? I said: I am ALL FOR knowing your rights. The topic was not what I had issues with at all. I had issues with the way it was brought under my attention (that retarded article you linked)

Yes, know your rights
Yes, defend your rights
Yes, be weary of the government bending the rules and invading your privacy.

And please, don't be a f*****g d*****s. If you have coke under your carseat I don't really care if they use anything you said pre-charge against ya. You're quilty.

I wasn't using 'If you don't do anything unlawful, you don't have to be scared' as an argument for the eroding of your rights. I was just saying: what are you really worried about? The principle is the principle, don't get me wrong, and worth adressing. But for gods sake, that article was stupid.

I think it's safe to say that if you don't consent to a search, or if you ask for a lawyer before answering questions, they're going to nail you for every piddling thing they possibly can and inconvenience you as much as possible in retaliation. You might win a moral victory, but it will come at a high price.

Rofl, cops cant even check your pockets if your walking down the street smoking a joint here Razz
They are trying to get a law through i think now though that allows them more leeway in dealing with crime specially in "bigger" city's like amsterdam but atm, it's a joke here Razz
