Long story... read as you will...
Got a VM today on my office phone. Some lady saying she needed to talk to me. I figured it was a sales call, but figured "I got 5 minutes to blow someone off".
Called back, find out its a collection agency. She starts by saying I had an unpaid debt of like $1,200 from BofA on a credit card since 1994.
I told her, she was nuts. I paid it off back then.
She then said, well whoever you paid didn't report it as paid and I have a signed affidavit. If you don't pay, we have to report it to the credit bureau.
I said, that's funny, I've got credit reports for the last 3 years that show that I don't have anything negative. If this is true, why didn't it show there?
She says, well its been sitting in "processing and validation" and it then had to be sold so we just got it. Then she said she sent me letters from October 2003. (BS, I never got shit).
I said, well, you're not getting a dime. I paid this already and I don't have the proof since it was f*****g 10 years ago. Bye.
So, I'm p****d cuz some b***h is threatening to put something on my spotless credit (yay 7 year statute on stupid mistakes from my youth).
I call back, ask to speak to a mgr, and get some dickhead, who spouted the same shit. I told him that since I never got the letter in the first place, that I wanted to see it.
He says, "sure, I'll fax it as long as you agree to pay and acknowledge this debt".
I'm not stupid, so I tell him that I'm not acknowledging anything but I want to see this documentation since I've never received anything.
He hangs up on me with the threat of processing the filing to the bureaus.
f**k me, am I p****d. I called back again and ask for another "manager". You guessed it, same shit different person. I start searching the net for the company name while on the phone with this dickhead. www.ripoffreports.com shows a ton of complaints about this company basically trying to get money from people on old written off debts (although, I'm pretty sure I paid this one... ).
So I tell the guy, "Look, I'm not stupid. I just did a search and guess what I found?"
He says, "Yah, check for your bank, creditors, etc... and see if they show up... since you're not going to pay we're sending it to the bureaus". Click!
So I search for my banks, and nada. Call back cuz I'm p****d as hell and ask for their address so that I can send them "something". He wants to only give me the PO box. I said, "Nope, for what I want to send I need your physical address". He doesn't give it and hangs up.
Beware... You have rights. There are reports of this company doing this for debts that are 20+ years old. They get the debs for pennies on the dollar or even free and try to collect something.

Doesn't your credit clear somewhat after like 7 years?

if it is indeed 10 yrs ago then you are crystal-- DO NOT PAY THEM JACK--
if you pay them or acknowledge the debt then they can legally put it on your credit report (and it restarts your 7yr timer)
if you dont do jack tell em to fek off whatever then there is nothing they can do-- make sure to keep an eye on your credit report- if they post it, dispute it- also you can sue them for attempting to put an outdated item on the report

Any debt you acknowledge or even make partial payments to restarts the entire debt to the most recent transaction date so it would be 7 years after that. What this and other companies do is pay a very small fee to the original loan holders who already have written off this debt as being uncollectable. They pay for a ton of loans for pennies on the dollar and then harass the debtor until they pay or do something stupid. Fortunately, Tav wasn't stupid.

well it's supposed to whipe clean after 10 years, but most credit agencies just shortened that to 7.
|

Not exactly.
Bad marks on credit reports go away in 7 years.
If you don't pay for something, they can take you to court. If they don't take you to court and/or cannot prove it they may simply put a bad mark on your credit. Certain unsecured debts like these are sold to collection agencies that try to bother you into paying for them. After 7 years of inactivity, they cannot officially report you again and the debt is unenforceable.
If you acknowledge the debt at any time though, or pay any part of it, the 7 years can legally start over.
