|
|
|
So even though the hurricane is going to most likely kill me this weekend I still have to move out of my old apartment by the end of the day Saturday but my question is this.
I put down a deposit of $1000 now I didn’t do any damage to my apartment and I will clear everything up and clean it before I am gone but I have heard from people that many landlords play with your deposit.
I was told they have 15 days to return my cash but to often I heard the landlords will find ways to take some of that deposit or delay giving it back.
So I turn to you Realpoorians to tell me your tales of moving and getting your deposit back or any other relevant information.

ive never had a problem getting it back- just have no damage and clean the place up -- some places take a cleaning fee out regardless tho (has to be in contract)
-- I thought they had 30 days to send it but Im not sure of that

in minnesota they have to give you double if they take more than two weeks to get it to you.
best way to get it back is to clean the shit out of your house then before you leave bring your landlord overthere and ask him if the place is clean enough or what do i have to do to make sure i get my whole deposit back.
he can't b******t you later if you says to your face everything is ok.

Also, if they keep any of the deposit, they need to itemize every deduction to show the individual repairs, clean up fees, etc...

If I liked you, and you were never a problem, I would give it back. If you were an ass, late rents, general problem child, you would not get it back. If you didn't clean to my standards I would deduct the cost of cleaning from the deposit. Same goes for fixing. If you put small holes in all the walls from hanging pictures you can kiss most of your deposit goodbye.
It all depends.

States have different laws regarding what your landlord can charge you for. Examples include: carpet cleaning and repainting.
If you happen to be a student, most universities have legal advice departments and their biggest customers are rent issues. If you're a student, make use of this free service.
I had a landlord try to charge me for cleaning of public access areas. It was quickly refunded after filling out simple form and he realized I wasn't going to accept this.

This is probably a good reason to research your landlord whenever possible before renting. Ask for a previous customer or look them up with the BBB and check for complaints. Make sure your leaving the place in decent shape, and if you haven't had too many issues (complaints or late payments) they should gladly return it to you.

Well I have never been late with a payment. I didn’t hang pictures or make holes. Never received a complaint from anyone and have been on very good terms with my landlord so I do foresee a problem but because of the stories I heard I figured I’d ask.

He was a dope. I could show 5 times the deposit in recipts of "work" done to bring the apartment back to renting condition, if I was driven too.
If the LL has 1/4 a brain and wants to keep your deposit, kiss it goodbye.

Exactly why I think researching Landlords ahead of time is important.

Because you are a c**t I would keep your deposit then hit you in small claims court for a few grand. I would win at least 25% of my claim and you would get stuck with another bill. You either pay it or have s****y credit untill the day you die. Been there done that, a few times.

He might have been a dope, there are lots of them in this world. The law is pretty clearcut in our state what landlords can charge for. Public access areas....he may as well have tried charging for cleaning the sidewalk.
