DUI with kids in the car?
FELONY OFFENSE
I love it.
The rest of you should tell your state to follow suit =p

It fills the prisons but I'm not sure it prevents the problem.

Your population is so small no one cares. You could drive drunk for an hr or 2 and not see another car.

I'm thinking there are no open container laws in Arkansas, either...but I like the felony status. NY can't be too far behind, can they, Kbarr?

True. I think between 2 and 5am theres no highway patrol on duty. So if you're ever driving through Montana in the middle of the night have fun.

Well, it would be a person to person basis. Mom drives home a little tipsy with junior, gets hauled in, the judge threatens her with 2 years in jail and then she never drinks again!
That, or the babysitting industry finds its great boom.

Sounds like a logical law to me.
Odds are NY will debate it for 10 years, then appoint a committee of "community" leaders, and talk about it a few more years.

Gotta agree w/ this. Unless they are ultra strict, like loss of your license for life, etc. People will continue to be asshats.

I never understood the stories about people with 5-10+ DWI arrests still driving cars, even without a license. I think there was 1 guy recently who had 56 DWI arrests.
Anyone can make a mistake 1 time, I do not think first time offenders should get massive penalties (without children that is) but for the people who have multiple arrests there should be several YEARS in jail for each time you get caught again. I would consider it attempted murder if they are found behind the wheel drunk.
You think the penalties are too harsh, then do not drive drunk - end of story.

the best way to do it is to have the punishment based on your BAC. If you're .1 that's totally different than someone at .15 or .2 or even .4 (with severe alcoholics). Let the impairment fit the punishment imo.

This would work well and all for repeat solo offenders (no children in car) but I seriously think that there should be a massive fine, a small amount of jail time, and a severe tongue lashing by a judge to the offender if they have kids in the car. I have a friend and her kids will come to some parties and what not. When this happens she stays off alcohol for at least 2 hours before driving and what she does drink in the early part of the party is maybe only a beer or two (and here in UT is all 3.2% baby!). She refuses to take that risk to them, not because of the jail time, but because of the kids. If someone doesn't have that kind of common sense they should get a stiff pole up the ass instead of a slap on the wrist.
