Seems to me you are spending too much time trying to get the "right" name and not enough time concentrating on making your company work. You build your name, your name dosen't build you.

Name is part of identity, nobody is going to go to a web design company with the name goobermilk industries. All part of the equation is corporate ID.
A regular (TM) isn't nearly as powerful in court as a registered trademark (R) I've spent a lot of time talking with CEO's and a few other folks and after this problem I've also talked with a few patent lawyers. (R) > ALL

Registered is definitely better, but if someone has a trade name in use in the industry you're in, yours can still be challenged. If they were in business before you, you will lose.

Right, I understand that. They got their Trademark in 2001. I registerd my Domain name in 1999 and the business in 1999 as well. It would be kinda interesting, but since orionstudios.com is into software and I'm doing graphics and we design, I'm pretty good to go. I'll be registering just in cas though and talking to more lawyers. Now to decide if I'm going to be registering the business in this state here or the state I'm moving to. Not sure if it really makes a difference and am gonna be spending time looking that up
