SAN FRANCISCO, California (AP) -- A Superior Court judge has ruled that a two-decade-old affirmative action program in San Francisco violates the sweeping ban on race and gender preferences California voters approved in 1996.
Judge James L. Warren said the city's public contracting rules, which include giving minority and women-owned businesses special notice of application opportunities and a 10 percent deduction from their bids, is an unconstitutional breach of Proposition 209, the 1996 state ballot measure that eliminated race- and gender-based government programs.
"The intent of the voters in adopting Proposition 209 was to outlaw race- and ****-based programs irrespective of the good will and moral position behind any particular program," Warren wrote in an opinion issued late Monday.
Matt Dorsey, a spokesman for City Attorney Dennis Herrera, said Tuesday that the city would appeal Warren's decision and it was not clear whether its agencies would have to stop considering race and **** while awarding contracts in the meantime.
San Francisco is one of only a handful of cities that still applies affirmative action in contracting following the voter's approval of Proposition 209. In 2000, the California Supreme Court struck down a similar contracting program in the city of San Jose.
The case was brought by the Sacramento-based Pacific Legal Foundation, a public interest law firm that works to limit the scope of government, on behalf of two construction companies that do business with the city.
"The voters of California spoke loudly to end racially driven programs and policies like those used in San Francisco," foundation attorney Sharon Browne said. "I am heartened that the court saw the issues clearly and handed down this victory for equality."

Yes he's being sarcastic. WheresNWS only b*****s and moans when "activist judges" tear at the "moral fabric" of America like they did in the gay marriage rulings. I bet you 10 bucks he saw this and sidestepped it.
