I thought this was satire, like The Onion or something when I read it yesterday. But apparently it's true (at least CNN has a story on it too). How is it possible a woman could go to a judge and say David Letterman is harassing her by using secret hand gestures and code words on his show, and actually get even a temporary restraining order granted? Aren't there any standards of reasonableness or plausibility, much less evidence, at all?

Letterman's longtime Los Angeles lawyer, Jim Jackoway, said Nestler's claims were "obviously absurd and frivolous."
"This constitutes an unfortunate abuse of the judicial process," he said.
Nestler's application for a restraining order was accompanied by a six-page typed letter in which she said Letterman used code words, gestures and "eye expressions" to convey his desires for her.
She wrote that she began sending Letterman "thoughts of love" after his "Late Show" began in 1993, and that he responded in code words and gestures, asking her to come East.
She said he asked her to be his wife during a televised "teaser" for his show by saying, "Marry me, Oprah." Her letter said Oprah was the first of many code names for her and that the coded vocabulary increased and changed with time.
Her letter does not say why she recently sought a restraining order.
Rogers' motion to quash the order contends the court lacks jurisdiction over Letterman, that Nestler never served him with restraining order papers, and that she didn't meet other procedural requirements.

Key word, temporary. It is what is given when you file for one.

That means you still have to show up to court to argue it in front of a judge, and odds are, he'll throw it out.

I could get a temporary order against you if I wanted =p

Well, if you're a nominee for a nobel price, you're already part of an exclusive club. It's not like they nominate 500 people and give it to one obvious choice.

Also, a temporary restraining order isn't comparable to a nomination, because it actually has an effect. It's not like you get that while the judge considers if a restraining order would be appropriate.

What I don't get about this case in particular is that she claims he's "contacting" her through his show with "secret code."
The judge, granting a temporary restraining order, essentially not only prohibits Letterman from visiting her, but also from contacting her. So, if the premisis of the restraining order is that he does indeed contact her through the show, does that mean he can't do his show until the order is lifted? Not that that's going to happen, but from a theoretical point of view it'd be interesting =/

Well the restraining order is in a NM state court. He films his show in NY. I am not sure how a state court in NM could prohibit him from doing his show in New York. Lettermans attorney's should file a counter restraint order that prohibits her from watching his show.
