So ive been seeing this girl for a few months now.
Apperantly she has some problems with her parents.
When she was 16 her grandma left her a big inheritance. SOmething like $100000
Now, 4 years later her parents found out she had the money and are doing everything to take it from her.
Because this money was left to her when she was still underage, apperantly her parents can just take the money easy.
She was underage, so they money was still theirs.
So now shes being sued by her parents for "stealing" $10000 she used of it.
She doesnt have a lawyer yet as this all happened yesterday, but her parents said they want the 10000 by monday or they'll have her arrested.
At this moment im absolutely shocked.. I really feel like kicking the shit out of her parents. They even threatened to have me arrested just because they ringed my doorbell at 6am and i told them to f**k off and come back at a decent time.
Now i think there are like 3 options.
Wait untill she gets a lawyer
Let her go to jail
Loan her the $10000 i have so she doesnt have to go to jail.
At the moment i really dunno what to do

get her a lawyer asap, you can counter sue for harassment at least and it might get them to drop their case

K, first I'm not a lawyer (yet :p), so take this with some caution - I'd be highly surprised if this wasn't how it is though.
| Quote: | | I really feel like kicking the shit out of her parents. |
You getting arrested for assault isn't going to do anyone any good.
| Quote: | | They even threatened to have me arrested just because they ringed my doorbell at 6am and i told them to f**k off and come back at a decent time. |
Thankfully, you can't go to jail for telling people to f**k off. Laugh at their threats. (not in their presence of course)
| Quote: | | Wait untill she gets a lawyer |
Yeah, make sure she gets one asap.
| Quote: | | Let her go to jail |
If she gets arrested she can just bail herself out - I doubt bail would be set very high, and there's still a good chance she might not get arrested at all.
When you say she's being sued, I presume you mean a civil suit - in that case she's not going to get arrested. If they pressed criminal charges (and by some miracle it'd actually lead to an arrest warrant), she can bail herself out.
As for the money:
The parents may have control over it as long as she's a minor, but the day she turns 18 she gets control over it. If the money was given to her, it never belonged to the parents. Having control over money and owning it are two entirely different things.
The fact that they threaten her to pay back the $10,000 she spent by monday, the first day she could actually get a lawyer, shows how little their chances of success are. Don't let them intimidate her.
What about the other $90k? They're only sueing for $10k, so do they have the other 90k on their name already? or is it still in her's?
Basically, never give anything back/away unless a court orders you to. If she gives it back now, there's nothing that'd stop the parents from spending it all before she even had a chance to go to court with it. Considering they're sueing their own daughter, they're probably not in a position to come up with it again once a court rules in her favor.
If she really needs help, and the account gets frozen by a court until the matter is decided, you could cover her bail - but do that only if you know she's going to show up for court...

As for the money. The parents somehow got the 90k out of her bank account, i dont know how they did it, as dutch law forbids something like that to happen unless they had a consent by the account owner.

Oh right, I forgot you're euro - that's good for you two, it means common sense can be applied =p
As to how they got the 90k.. If I had to guess, I'd say they threatened to sue her for the 100k and she gave the 90k she still had voluntarily.
Since you're not in the US I'd change my advice from 'get a lawyer' to 'do nothing' regarding those 10k. Just ignore that it was even brought up. Focus on getting the other 90k back only. If they actually go through with sueing for those 10k (which I highly doubt), you still have more than enough time to contact a lawyer and get it straightened out.
What you can do, though, is call a lawyer and ask for information regarding the ownership of a minor's bank account. Explain the case briefly (minor inherited money and deposited on her own bank account, person is now an adult and parents sue for the money because she got it as a minor) - he can tell you how it's going to end in about 2 minutes.
They're usually more than happy to help you out with that kind of info without charging anything (when you call just ask if they have a few minutes to help you out), and you don't need them to file anything. Euro law is pretty straight forward - either you get it or not. There's not much room for argument, especially not in a case like this.
Regarding those 90k (if it happened the way I think it did), she can get them back saying she was in a state of emotional distress and her parents abused the fact that she was in a vulnerable position and therefore scared of a lawsuit, voiding whatever she signed for them. No judge is going to believe she voluntarily gave up the money from her good heart, if it was followed by the threat of a lawsuit for the remaining 10k...
But it's imperative that you have the WHOLE story before fighting for her. Nothing worse than sitting in court just to get surprised by some fact your friend 'forgot' to mention.
| Quote: | | i dont know how they did it |
Before you do anything, make sure you know
It's after all her money, and if she says "well, I don't know", then she's clearly not interested in getting it back, and you're better off without her. As you said, there's NO WAY they can get it without her signature. In fact, the bank would most likely call to confirm it.
As evil as those parents sound, I doubt they'd forge a signature and fake a phone call - you get pretty long jail sentences for that.

OK, so some advice from a trust fund baby, I'll tell you she needs to see an attorney. There's too much we dont know. Was she emancipated? If not, a guardian *was* named when the funds were distributed. If the guardian allowed her to access the money, the parent are S.O.L. Having a trust of my own, I know quite a bit about trust accounts, and 100k was probably left in trust, not just a huge inheritance.
She NEEDS to talk to an attorney.

i was going to say put the remaining 90k in a locked security box under your name, but i guess its too late for that.
my advice is to ignore their threats for the other 10k and focus on the 90k taken from the account.
and get a lawyer.

they didn't take it out of her bank account, wtf u talking about.
this is so stupid, they have no case, is this a fake occurance... i don't get it. Her parents have no right to the money in their daughters name EXPECIALLY since she is now 18. They can't have her arrested for keeping her OWN money. They can't have you arrested for telling them to f**k off. How about you HAVE THE f*****g PARENTS ARRESTED FOR BLACKMAIL. They are telling you to pay them money or they will enflict harm upon you (duress). call up the fuckign cops, file a report.
In essence, DO THIS:
Get a f*****g lawyer. file a lawsuit AGAINST the parents for harassment, etc. etc. File for a restraining order against said parents. Collect money form judgement against retarded parents. Live hapily ever after.

100000000 1000000 1000000 10000000 100000000
100000000 1000000 1000000 100000000 1000000000
Can you find the number above which fits neither of these conditions?
it is either: 1 million, or one hundred million.
it takes less time when you write: 10,000,000.
use commas, they'll save you from misinterpreting an entire inheritence from 1/10 of an inheritance.
