I'll wait for an article from "The Economist" to closely examine a list of his cases, but from the CNN 'developing story'

Quote:

In Fatin v. INS (1993), Alito joined the majority in ruling that an Iranian woman seeking asylum could establish eligibility based on citing that she would be persecuted for gender and belief in feminism.

So that pretty much opens the door for every muslim woman. I'm not claiming they don't have a hard time, but when you're regulating immigration, you don't want regulation that makes half a billion people eligable.

Quote:

In a 1996 ruling that upheld the constitutionality of a federal law banning the possession of machine guns, Alito argued for greater state rights in reasoning that Congress had no authority to regulate private gun possession.

Kbarr's probably going to lynch me over that one, but what exactly is the point of legalizing machine guns for private use? Armed robberies seem dangerous enough for cops already, without having the guy shoot around with a full automatic rifle. Not that making it illegal completly removes the problem, but at least it makes it harder to get your hands on one.

Doesn't seem like a die-hard conservative to me... from what I've read so far he's probably a good - and balanced - choice. Time will tell though.

What's this?! You're talking about my freedom to own a heavy machine gun! Are you against freedom, Soriak????

I'd like to know just how many armed robberies have taken place using automatic rifles in the past 10 years.

Thats a misleading quote from CNN (big suprise).

He was the lone dissenter in US v. Rybar which upheld a federal statute making it "unlawful for any person to transfer or possess a machine gun." Alito would have stricken the law as unsupported by the Commerce Clause powers of Congress. This case and other recent challenges to the federal ban on NEW machineguns for private individuals have been shut down on the basis of the supreme court saying the manufacturing and transfer of MGs falls under the commerce clause. Alito is for states deciding if they wish to allow MGs for private citizens.

MGs are already legal for individuals to own on a federal level (state laws can be different). What happened was the federal gov't banned the manufacture (in 1986) and importation (in 1968) of NEW machineguns for private individuals. The government and law enforcement agencies can still buy new ones.

What this has caused is an insane amount of inflation in the price of transferrable MGs. The same M16 that you could buy in 1985 for $800-$900 now costs $12,000 to $14,000.

The issue of ciminals having MGs for their 'armed robberies' is moot. There has not been a crime committed with a legally registered MG since 1934 (when they instituted the registry). No thug is gonna cough up $12k for an M16 to rob a liquor store. He's gonna drill the whole in the receiver himself and buy the $5 in parts it takes to complete the conversion to full auto.

I had a friend who worked at a mini-mart that said he would give up the goods if anyone so much as threatened him with fisticuffs.

I'd like to hear his positions on states rights and on the commerce clause.

last few rulings have basically said that there are no states rights because of the commerce clause

The point?

You need to ask a better question. What is the point of that shirt I saw you wearing in the picture. TELL MNE THE POINT!

See? hard to answer huh?

And who told you, exactly where did you get your info, that a law would make it harder for a criminal to get or make a fully automatic weapon. You do understand that most semi-automatic weapons can be modified to full auto with a small file and a little knowledge.

If the shit hit the fan i could be full auto with about 7 weapons in an hr or so, even less if I was rushed:)

What are you all talking about, abortion is all that matters!

And yeah, there's no reason for someone to get a legally registered machine gun to commit crime with, there are plenty of much cheaper and less traceable options. Sure they're illegal, but criminals, sorta by definition, don't follow the law.

I would come armed with a torch, and hope that by waving it back and forth in front of their faces they would get frightened, and run away. Otherwords In my offhand I qould be holding a stick, of decent length, and width. I'd try hitting them with my stick as a last resort. If else failed I would run away. How quickly can a giant spider move?

Yeah I'm shocked a Jesus freak president would pick a pro-life, conservative judge. Rolling Eyes

Hey, instead of continually trying to placate his Christian minions (and failing to do so), why doesn't Bush try doing something useful with this second term? Oh, I don't know... maybe work on the budget or something. Maybe he can put a real emergency action plan into effect so we don't lose anymore major cities. Something would be great, anything, really.

What a disasterous presidency. Stop voting for morons.
